ITCH DOOEL Apps – Privacy Policy

ITCH DOOEL ("Company", "we" or "us") respect the privacy of the users ("User" or "you") of the mobile applications we make available ("Apps"), and we are committed to protecting Users' information. This Privacy Policy explains what information we may collect when you use our Apps, how we use it, and the choices available to you.

For the purposes of applicable data-protection law, including the EU and UK General Data Protection Regulation ("GDPR"), ITCH DOOEL is the data controller responsible for deciding how and why your Personal Information is processed in connection with the Apps. You can contact us at any time at contact@theitch.tech.

Our Apps are general-audience applications. They are not directed to children and are not intended for use by children. By making the Apps available, we do not knowingly collect personal information from children. If you believe that a child has provided us with personal information, please contact us at contact@theitch.tech and we will take steps to delete it.

1. Your Consent (important – please read carefully)

By installing the Apps on your device, or by connecting to, accessing and/or using the Apps, you agree to the terms of this Privacy Policy, including to the possible collection and processing of your Personal Information as described here. If you do not agree to any term of this Privacy Policy, please do not install, access or use the Apps, and please remove them from your device.

2. Which Information May Be Processed?

Two categories of information may be processed in connection with your use of the Apps:

2.1 Non-personal Information

Non-identifiable and anonymous information ("Non-personal Information") may be collected, stored and/or processed by us and/or by third-party providers of certain products and services, such as advertising networks and analytics providers ("Third Parties"). Neither we nor our Third Parties are aware of the identity of the User from whom Non-personal Information has been collected. Some jurisdictions may treat certain elements of this information as personal information; for more detail, see Section 18 below.

Non-personal Information may include technical and usage data such as: type and version of operating system (e.g. Android, iOS), session identifier, time zone, session start/stop time, source of traffic (e.g. the ad, site or campaign a User came from, and associated revenue), App version, language, device type/model, data regarding User behavior within the Apps (e.g. ad impressions and responses to ads, including ads viewed or clicked), gameplay data (e.g. level reached, time spent in the App and in each level, progress, fail rate, virtual items used, screens accessed, retention), performance and stability data (e.g. crashes and errors), other predefined events (e.g. connectivity type, device time zone), our other installed Apps, and geo-location at country level only. No street-level location is collected.

2.2 Personal Information

Individually identifiable information ("Personal Information") is information that may identify an individual and/or may be of a private or sensitive nature. We may collect and/or process, directly or through Third Parties, the following types of Personal Information:

We may collect, use and provide access to the User's advertising identifier in accordance with the applicable platform provider's rules, policies and guidelines (such as those of Apple or Google).

In addition, Third Parties may track and collect information about your online activities over time and across different platforms (such as websites and applications). For more information about limiting such tracking, see Section 12 below.

Any Non-personal Information that is connected, linked or associated with Personal Information will be treated as Personal Information for as long as that connection exists.

We do not collect or process any financial or payment information, government identification numbers, non-public phonebook or contact information, or any sensitive device data.

Some Apps may access information on your device without the Company carrying out any processing. In these cases, the App may access information locally, but that information is not transmitted off your device and the Company does not collect or use it. This access is solely to enable particular App features.

Photo and Video feature

Some Apps may let you take a photo or create a video using your device camera, and apply filters or edits within the App. This feature is optional, and you can use the App without it. If you use it, you will need to grant the App permission to access your camera (which you can revoke at any time through your device settings, without affecting your use of the App). Photos and videos you create are stored locally within the App and are retained until you delete them or uninstall the App. The App does not collect face data, and the photos and videos you create are restricted to the App, stored locally and not transmitted to the Company's servers, nor used or accessed by the Company. You may choose to share such content from within the App using your device's share functionality; any such sharing will be governed by the policies of the relevant platform.

3. How Is Information Collected?

3.1 Through your use of the Apps. When you use an App, we and our Third Parties may gather information relating to that use through the Apps, or through APIs or SDKs embedded in the Apps. Information may also be stored locally on your device using generally accepted technologies such as "cookies" and local storage (see Section 11 below).

3.2 Voluntarily. We collect information that you provide to us directly, for example when you submit a support request.

In addition to the sharing of Personal Information with Third Parties described in Sections 2–4 above, we may share Personal Information in the following cases:

Some Apps may allow Users to create their own content, such as images, photos or videos ("User Generated Content"), and may include a feature allowing Users to share it. User Generated Content may include Personal Information. We do not access, use, collect or share this content; it is restricted to the specific App, stored locally on your device, and not transmitted to our servers. You acknowledge and agree that you are solely responsible for sharing your information with others and that you do so at your own risk.

6. Advertising

We display ads in various formats (such as banners, interstitials and rewarded videos) from Third-Party ad networks within our Apps. These ad networks may collect and use: (i) information about your use of the Apps in connection with advertising activities; (ii) geographic and carrier-network signals; and (iii) information logged from your device (such as approximate age, gender and similar attributes) in order to present appropriate advertising, control the number of times an ad is shown, deliver ads relating to your interests, and measure campaign effectiveness. The delivery of ads may be based on your IP address, device identifiers and other Personal Information collected during your use of the Apps. You may also be shown contextual or non-targeted ads. You can find the list of Third-Party ad networks providing services in relation to our Apps at: https://theitch.tech/3rdParties. If you click on an ad, the advertiser may use cookies and other tracking technologies to collect data about ad performance and your interests in order to serve you ads, including targeted ads. We recommend reviewing the privacy policy of any advertiser you interact with; their policy, not ours, will apply to those interactions.

We may promote our Apps within third-party applications and platforms, and we may advertise our other Apps within the Apps. Such promotions are not directed to specific Users but are broadly distributed.

7. Third-Party Providers

When you use the Apps, Third Parties may collect, store and/or process the information described in this Privacy Policy. You can find the list of Third Parties at: https://theitch.tech/3rdParties. These Third Parties are carefully selected with the aim that they, and any related entities that may access your information, provide it with protection consistent with this Privacy Policy, applicable privacy laws and the platform providers' rules. We use commercially reasonable efforts to engage Third Parties that publish a privacy policy governing their handling of personal and non-personal information. For further details on how Third Parties process your information, please review their respective privacy policies.

8. Other Applicable Third-Party Terms

Your access to and use of the Apps may be subject to certain third-party terms and privacy policies, including those of application stores, mobile-software platforms and other Third Parties. We do not control such third parties and are not responsible for their privacy practices. You should review their privacy policies to understand how they may collect and use your information.

9. Links to Third-Party Sites

Certain links in the Apps, through ads or otherwise, may take you to third-party sites, products or services that are not under our control. Most of these provide their own terms and privacy policies. We recommend reading those documents carefully before using such sites and services.

10. Game Center Features

Some Apps may enable certain social and gaming features that integrate with third-party gaming platforms ("Game Center Features" and "Platforms"), such as Apple Game Center or Google Play Games. These Platforms are created and maintained by third parties that are not affiliated with or controlled by us. If you enable this integration, your use of the Game Center Features is subject to the terms of use and privacy policies of the applicable Platform provider. We recommend that you read those terms and privacy policies to understand how they treat your information and how to change the relevant privacy or sharing settings. If you do not agree to their practices, you should not enable the Game Center Features, although you may then be unable to use all features of the Apps.

Where you enable interaction with a Platform, we may share data about you with your contacts on that Platform (and vice versa) so that you can enjoy social elements. This data may include your scores and progress within the Apps, your name, your social-media profile picture and any content you choose to upload.

By using the Game Center Features, you acknowledge and agree that the applicable Platforms may collect certain Personal Information, such as your IP address, as well as Non-personal Information, and may set cookies and/or other tracking technologies to enable the functionality of the Game Center Features. These features enable the sharing of information with your friends or the public, depending on the settings you establish with the relevant Platform. You understand that when you share content via a Platform, that content may become public and may be re-posted by others.

11. Cookies & Local Storage

When you use the Apps, we and/or our Third Parties may use industry-standard technologies such as "cookies", web beacons, tags and local storage ("Local Storage") to identify a device and remember information about a User. This may enable features such as remembering your preferences (e.g. whether sound is muted), measuring use of the Apps, frequency capping, improving service quality, measuring ad performance and serving relevant ads. Such information is stored locally on your device, and we and/or our Third Parties may access it. Third Parties may use both session cookies (which expire when you close the App) and persistent cookies (which remain until deleted). Local Storage may hold Non-personal Information as well as a persistent identifier and country-level geo-location data. You can delete Local Storage, including by uninstalling the App or through your device settings. If you block or erase such technologies, your App experience may be affected.

12. "Do Not Track" and Opting Out of Interest-Based Advertising

You can prevent or limit targeted advertising through your device settings, which vary from device to device. Please note that activating any "Do Not Track" or similar device-level setting may not stop all tracking activities by our Third-Party service providers.

To opt out of the use of your information for interest-based and targeted advertising by certain of our Third-Party service providers, please review the privacy practices of those Third Parties and follow their instructions. You can find a list of our Third Parties, with opt-out instructions where available, at: https://theitch.tech/3rdParties.

Opting out will not stop ads from appearing, but may make them less relevant to your interests. The companies you select may still collect information for other purposes such as research, analytics and internal operations. If you use a different device, or erase cookies, you may need to renew your opt-out choice.

You can also limit Apple's targeted advertising in Settings › Privacy › Apple Advertising by turning off Personalized Ads.

13. International Data Transfers

We may transfer and store information collected about you, including Personal Information, to our Third-Party service providers across borders, including to countries that may not have the same data-protection laws as your own jurisdiction. Wherever your Personal Information is transferred, we take reasonable steps to ensure it receives an adequate level of protection. Where required, we rely on appropriate transfer safeguards, such as transfers to countries recognized as providing an adequate level of protection under an adequacy decision of the European Commission or the UK authorities, or the use of Standard Contractual Clauses approved by the European Commission (and the UK International Data Transfer Agreement or Addendum, as applicable). Where we receive requests for information from law enforcement or regulators, we carefully validate those requests before any Personal Information is disclosed. You can request further details of the steps we take, or a copy of the relevant safeguards, by contacting us as set out in Section 20 below.

14. Additional Rights for Users in the EEA and UK

If you are located in the European Economic Area (EEA) or the United Kingdom (UK), this Section provides additional information required under the GDPR.

Legal bases for processing. We process your Personal Information on the following legal bases: (i) performance of a contract, where processing is necessary to provide the Apps and the features you request; (ii) our legitimate interests, where processing is necessary for purposes such as measuring and improving our Apps, securing them against fraud and abuse, and serving non-personalized advertising, provided those interests are not overridden by your interests and rights; (iii) your consent, where required for personalized or interest-based advertising and any associated use of device identifiers and similar technologies, which you may withdraw at any time; and (iv) compliance with a legal obligation, where processing is necessary to meet our legal or regulatory requirements. Where we rely on consent, withdrawing it will not affect the lawfulness of processing carried out before withdrawal.

Rights. Subject to legal exemptions, you have the right to access your Personal Information; to request its correction or erasure; to object to or request restriction of its processing; to data portability; and, where processing is based on consent, to withdraw that consent at any time. Where we rely on legitimate interests, you may object to processing on grounds relating to your particular situation. You also have the right to lodge a complaint with your local data-protection supervisory authority. To exercise any of these rights, please contact us at contact@theitch.tech. We will respond in accordance with applicable law.

15. California Privacy Rights

15.1 If you are a California resident under the age of 18 and a User, California Business and Professions Code Section 22581 may allow you to request removal of content or Personal Information you have publicly posted. If you wish to remove such content and you identify it specifically, we will do so in accordance with applicable law. Please note that removal may not be complete or comprehensive, and that there may be circumstances in which the law does not require us to enable removal.

15.2 This section contains disclosures required by the California Consumer Privacy Act ("CCPA") and applies only to "personal information" that is subject to the CCPA.

Your Rights Regarding Personal Information. Subject to certain exceptions, California residents may exercise the following rights:

To exercise any of these rights, please contact us by e-mail at contact@theitch.tech and provide the information needed to verify your request.

You may also opt out of the sale of your personal information by using the "Do not sell my Personal Info" option (or a similarly named option) available within the privacy settings of some of our Apps. This will stop the sale of your personal information within those Apps; you will still receive advertising that helps us provide the Apps to you.

Your opt-out of the sale of personal information is tied to your device's advertising identifier. On iOS, this is based on the IDFV, and on Android, on the Google Advertising ID. If you reset your advertising identifier, your opt-out selection may not carry over to the new identifier and you may need to select it again.

We do not collect or process sensitive personal information as defined under the California Privacy Rights Act (CPRA).

We do not sell the personal information of Users located in California whom we know to be under the age of 16.

We may need to request additional information to verify your identity or understand the scope of your request, although you will not be required to create an account to submit a request. You may designate an authorized agent to make a request on your behalf by providing the agent with written permission and verifying your identity with us.

16. Deletion and Modification of Information

You, or where applicable your agent, may request, by e-mail to contact@theitch.tech, that we:

One Third Party we work with in relation to our Apps is AdMob. We cannot amend or delete Personal Information collected and stored by AdMob; however, you may modify or delete such information using the tools and instructions provided by AdMob. For details, please refer to the AdMob Privacy Policy and Google Partner Sites Policy.

For some Apps we may provide in-app deletion-request functionality in addition to the e-mail address above.

After you stop using the Apps, we will retain your Personal Information for a reasonable period as necessary to fulfil the purposes for which it was collected, including to comply with our legal or business requirements, resolve disputes, prevent fraud and enforce our agreements, all as permitted under applicable law. Aggregate and/or anonymous information may remain on our servers indefinitely.

Where game progress is saved to your device's cloud backup (such as iCloud or Google Drive), this occurs within your own account, which we cannot access. We therefore cannot delete that data as part of a deletion request; you will need to remove it yourself from your cloud account.

17. Security

The security of your information is important to us. We take reasonable measures to maintain the security and integrity of our Apps and User information and to prevent unauthorized access, using generally accepted industry-standard technologies and internal procedures. However, there are inherent risks in transmitting information over the Internet or storing it electronically, and we cannot guarantee that unauthorized access will never occur. To the fullest extent permitted by law, the Company shall not be responsible or liable for unauthorized disclosure or access, hacking, or other security intrusions, or for the theft, alteration, deletion, corruption, destruction, damage or loss of any data or information.

18. Treatment of Information in Certain Jurisdictions

Some jurisdictions treat certain identifiers and online activity data as personal information even where we do not associate them with an identified individual. Where that is the case, we handle such information in accordance with the applicable law of that jurisdiction, including, for California residents, as described in Section 15 above.

19. Changes to This Privacy Policy

This Privacy Policy governs the use of the Apps and any information collected through them. We may change this Privacy Policy at any time, so please revisit this page periodically. In the event of a material change, we will make reasonable efforts to post a clear notice within the Apps and/or on our website. Material changes will take effect five (5) days after notice is provided, whichever is earlier. All other changes are effective as of the "Last Revised" date, and your continued use of the Apps on or after that date constitutes acceptance of the changes.
